The Second Civil Chamber of the Ticino Court of Appeal examined whether an appeal could proceed after the appellant had been ordered to pay a CHF 1,500 advance on costs by 20 November 1995. Following an inquiry with the PTT current account service, the court found that the payment order data were sent only on 21 November 1995 and credited on 23 November 1995, both after the deadline. In the use of the PTT collective transfer service, payment is timely only if the data carrier bears a due date no later than the last day of the judicial time limit and is delivered to a Swiss post office within that period (cf. DTF 117 Ib 222; DTF 118 Ia 11 consid. 2a and 2). If either of these cumulative conditions is not met, the advance is late and the appeal must be declared inadmissible; the procedural costs follow the unsuccessful party.

Ritenuto in fatto e considerato in diritto:

che con diffida 2 novembre 1995 del presidente di questa Camera al ricorrente veniva assegnato un termine scadente il 20 novembre 1995 per effettuare sul c.c.p. 01-18783-5 del Tribunale d’appello -introiti AGITI- un deposito di fr. 1’500.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;

che, secondo l’inchiesta svolta dalla Tesoreria del Tribunale di appello presso il Servizio dei conti correnti della Direzione generale delle PTT, il supporto dei dati (nastro magnetico), allestito dalla banca cui si è avvalso il ricorrente e su cui si trova l’ordine di pagamento, è stato spedito alla citata direzione il 21 novembre 1995 con indicata la scadenza del 23 novembre 1995, onde l’accredito è stato effettuato in quest’ultima data;

che per l’utilizzazione del servizio degli ordini collettivi (SOC) delle PTT, il termine per versare un anticipo delle spese è considerato come rispettato se la data di scadenza determinata sul supporto dati corrisponde, al più tardi, all’ultimo giorno del termine fissato del Tribunale e se il supporto dati è stato consegnato entro tale termine a un ufficio postale svizzero (DTF 117 IB 222; cfr. anche DTF 118 Ia 11 seg. consid. 2a e 2 e pure sentenza TF 5P.217/1995 del 4 luglio 1995);

che in concreto il pagamento è tardivo perchè entrambe le date determinanti come ai considerandi che precedono sono successive rispetto al termine assegnato, ragione per cui il gravame deve essere dichiarato inammissibile;

che le spese inutili sono sostenute da chi le ha cagionate,

richiamato l’art. 312 cpv. 2 CPC

decreta 1. L'appello 27 ottobre 1995 __________, è inammissibile.

  1. Le spese del presente giudizio con tassa di giustizia per complessivi fr. 100.-- sono poste a carico dell'appellante.
