The Second Civil Chamber of the Ticino Court of Appeal dismissed an appeal against a first-instance judgment in a debt-denial action arising from the installation of roller shutters and awnings. The appellant sought to set aside the finding of frivolous litigation, obtain an expert report, and maintain his opposition to enforcement. A finding of frivolous litigation is warranted where the party's resistance is unsupported by any justifiable ground and serves merely to delay contractual performance. Costs follow the outcome and may be charged to the unsuccessful appellant.

in materia di disconoscimento del debito riguardante una pretesa d’appalto che il Pretore, con sentenza 5 ottobre 1995, ha integralmente respinto accertando altresì la temerarietà della lite promossa dall’attore.

Appellante quest’ultimo con atto d’appello 23 ottobre 1995 con il quale chiede l’annullamento della dichiarazione di temerarietà, l’allestimento di una perizia ed il mantenimento dell’opposizione da lui interposta al precetto esecutivo il cui rigetto provvisorio ha dato luogo all’azione di disconoscimento del debito.

Letti ed esaminati gli atti ed i documenti di causa

Considerato

in fatto ed in diritto

che, con la sentenza qui impugnata, il Pretore ha respinto le eccezioni dell’attore riguardanti una fornitura e posa di rolladen e tende da sole, effettuata dalla ditta convenuta, pretesa difettosa poiché non é stata dimostrata la tempestiva e regolare notifica dei difetti;

che, indipendentemente dalla carenza dei pur minimi presupposti formali voluti dall’art. 309 CPC per rendere ammissibile un atto d’appello, il gravame dell’attore si rivela completamente infondato;

che infatti la sua pretesa di disconoscimento é stata respinta mancando qualsiasi tempestiva notifica dei difetti per i quali si opponeva al pagamento della fornitura e che tale motivazione non é assolutamente contestata, anzi é ammessa quando afferma, nell’appello, che “non mi sono formalizzato a notificare ufficialmente i difetti...”;

che ne segue come anche la domanda di allestimento di una perizia per accertare eventuali difetti non possa trovare consenso perché é inutile sapere se esistono veramente difetti in un’opera quando é pacifico che la relativa azione in garanzia é improponibile mancando l’indispensabile presupposto della tempestiva notifica dei difetti stessi, come ha correttamente giudicato il Pretore con l’ordinanza sulle prove 12 luglio 1995;

che anche la declaratoria di temerarietà della lite trova consenso in questa autorità d’appello per i pertinenti motivi addotti dal Pretore ai quali si rinvia non mancando di osservare che l’inconferente appello dell’attore dimostra, ancora una volta, come la sua resistenza non sia sorretta da alcun giustificato o giustificabile motivo se non quello di procrastinare nel tempo il momento dell’adempimento dei suoi obblighi contrattuali;

che l’appello può così essere respinto già all’esame preliminare dell’art. 313bis CPC senza necessità di intimarlo per le osservazioni alla controparte;

dichiara e pronuncia

  1. L’appello 23 ottobre 1995 __________ é respinto.

  2. La tassa di giustizia in Fr. 100.- e le spese in Fr. 20.- (totale Fr. 120.-) sono a carico dell’appellante.
