The First Civil Chamber of the Ticino Court of Appeal dealt with an appeal against a first-instance order granting definitive registration of a builders’ lien in part. The appellant failed to pay the requested advance on appeal costs by the deadline because its bank executed the transfer one day late. The court held that the bank had to be treated as the party’s helper, so the delay was attributable to the appellant. It therefore refused restitution in integrum, struck the appeal from the docket, imposed reduced court costs of CHF 100 on the appellant, and denied compensation to the respondents, who had not even been served with the appeal.

If the appeal is struck out for untimely payment, the procedure ends without judgment; costs are imposed on the party causing them, subject to reduction of the court fee, and no party compensation is due where the appeal has not even been served on the other side (consid. 3).

visto l'appello del 3 giugno 2002 presentato dalla __________ __________ contro la sentenza del

13 maggio 2002 con cui il Pretore del Distretto di Lugano, sezione 3, ha ordinato l'iscrizione definitiva di un'ipoteca legale degli artigiani e imprenditori in favore dell'attrice per la somma di fr. 1804.55 con interessi sulla proprietà per piani n. __________ (pari a 41/1000 della particella n. __________RFD di ), appartenente a __________ __________ -, respingendo l'azione per il resto;

ricordato che il 7 giugno 2002 l'appellante è stata invitata a depositare entro il 25 giugno 2002, a titolo di anticipo per le spese giudiziarie presunte, la somma di fr. 1000.– sul conto corrente postale --__________del Tribunale di appello, introiti agiti, con l'avver­ten­za che, decorso infruttuoso il termine, l'appello non sarebbe stato esaminato nel merito (art. 312 cpv. 2 CPC) e che, fosse stata incaricata una banca di eseguire il versamento, sarebbe spettato all'attrice provvedere perché ciò avvenisse tempestivamen­te;

accertato che nella fattispecie la UBS di Locarno, incaricata dall'attrice il 21 giugno 2002 di procedere al pagamento con valuta 25 giugno 2002, ha dato seguito all'ordine –– per ragioni ingiustificate – solo l'indomani (con valuta di quel 26 giugno 2002);

ritenuto che nelle circostanze descritte il deposito risulta tardivo, sicché l'appello sfugge a ogni possibile trattazione;

preso atto ora della lettera 27 giugno 2002 con cui l'attrice, pur riconoscendo la tardività del versamento, chiede di non stralciare l'appello dai ruoli poiché nessuna colpa le è im­putabile;

considerato che tale lettera può essere interpretata come una domanda di restituzione in intero contro il lasso dei termini (art. 137 CPC);

rilevato nondimeno che una banca incaricata di effettuare un'anticipazione delle spese (art. 147 CPC) va equiparata – per diritto federale – a un'ausiliaria del patrocinatore, rispettivamente della parte (Poudret, Commentaire de la loi fédérale d'organisation judiciaire, vol. I, Berna 1990, pag. 242, n. 2.6 ad art. 35 con richiami);

rammentato che, per costante giurisprudenza del Tribunale federale, in casi del genere gli ausiliari si identificano con il patrocinatore, rispettivamente con la parte, sicché la colpa dei primi va assimilata a quella dei secondi (Poudret, loc. cit.);

osservato che finora la Camera civile di appello si è attenuta al medesimo orientamento del Tribunale federale (Cocchi/Trezzini, CPC massimato e commentato, Lugano 2000, n. 32 ad art. 137), dal quale non v'è motivo di scostarsi in concreto, l'attrice essendo stata esplicitamente avvertita che, avesse incaricato una banca di procedere al versamento, le sarebbe spettato di vigilare affinché l'operazione avvenisse tempestivamente;

appurato che, ciò premesso, nella fattispecie non soccorrono i requisiti per accogliere la domanda di restituzione in intero;

posto che, dandosi stralcio dell'appello, gli oneri processuali vanno a carico di chi li ha provocati, ma che la tassa di giustizia dev'essere adeguatamente ridotta, la procedura terminando senza sentenza (art. 21 LTG);

stabilito che non si giustifica di attribuire ripetibili alle controparti, cui l'appello non è nemmeno stato intimato;

richiamato l'art. 12 cpv. 1 e 2 LTG,

decreta: 1. L'appello è stralciato dai ruoli per tardivo versamento dell'anticipo.

  1. Gli oneri processuali, consistenti in:

a) tassa di giustizia fr. 50.–

b) spese fr. 50.–

fr. 100.–

sono posti a carico dell'appellante. Non si assegnano ripetibili.
