visto l’atto di appello 26 febbraio 1996 del convenuto contro la sentenza emanata il 13 febbraio 1996 dal Pretore della giurisdizione di Locarno-Campagna;

richiamata la diffida 28 febbraio 1996 della presidente di questa Camera mediante la quale all’appellante è stato assegnato un termine scadente il 18 marzo 1996 per effettuare sul __________ --__________della __________ del Tribunale di appello un deposito di fr. 400.– a titolo di anticipo per le presumibili spese giudiziarie, con la comminatoria che, nel caso di mancato versamento dell’importo nel termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell’art. 312 CPC;

ricordato che il termine per il versamento di un anticipo spese è considerato come rispettato se la data di scadenza indicata sul supporto dati coincide, al più tardi, all’ultimo giorno del termine assegnato per l’anticipo spese e se il supporto stesso è stato consegnato entro tale termine a un ufficio postale svizzero (DTF 118 Ia 11 seg. consid. 2 a e b);

preso atto che in concreto il supporto dati magnetico è stato spedito il 18 marzo 1996, ma che l’anticipo è stato versato il 19 marzo 1996, conformemente alle istruzioni figuranti sul nastro magnetico, come risulta dalle informazioni fornite dalla __________ __________ delle __________, motivo per cui il versamento è tardivo;

decreta :

  1. L’appello è stralciato dai ruoli per mancato versamento dell’anticipo.

  2. Gli oneri processuali consistenti in :

a) tassa di giustizia fr. 80.–

b) spese fr. 20.–

fr. 100.–

sono posti a carico dell’appellante.
