The First Civil Chamber of the Ticino Court of Appeal dealt with an appeal against a first-instance dismissal of a possessory action for lack of jurisdiction. Art. 151 CPC; withdrawal of an appeal as desistance and allocation of costs; the withdrawal of a remedy terminates the appellate proceedings and is, in principle, assimilated to defeat for the withdrawing party. Costs and party compensation are then fixed by the seised court upon request. Under Art. 148 CPC, absent special grounds, the withdrawing party bears the judicial costs; the court retains broad discretion in assessing equitable compensation. The court may nevertheless reduce the judicial fee under Art. 21 LTG when no decision on the merits has been issued. Under Art. 150 CPC, compensation must remain within the tariff limits and reflect the nature, value, and necessary work performed; no compensation is due to a party that did not take a position on appeal.

premesso che il Patriziato di __________ ha interposto il 24 ottobre 1994 un appello contro un decreto emesso il 17 ottobre 1994 dal Pretore del Distretto di __________, con cui è stata respinta, per incompetenza giurisdizionale, l’azione possessoria introdotta dallo stesso Patriziato di __________;

preso atto che il 17 marzo 1995 l’appellante ha dichiarato di ritirare il gravame, le parti avendo raggiunto un accordo;

visto che il Patriziato di Ira__________a, con lettera del 4 aprile 1994, ha comunicato di non rinunciare alle ripetibili di appello;

ricordato che se una causa è tolta per desistenza, transazione o acquiescenza le tasse, le spese e le ripetibili sono stabilite, a richiesta di parte, dal giudice adito (art. 151 CPC);

osservato che il ritiro dell’appello equivale a desistenza (Rep. __________375), pone fine alla procedura di ricorso e comporta, in linea di principio, l’addebito degli oneri processuali con obbligo di rifondere alla controparte una congrua indennità per ripetibili;

rilevato che in caso di desistenza la valutazione dell’equa indennità considera il recedente, seppure con un largo margine di apprezzamento in ogni singola fattispecie, come soccombente totale o parziale (Cocchi/Trezzini, CPC annotato n. 10 ad art. 148);

accertato che nel caso concreto non risultano giusti motivi per suddividere tra le parti le tasse, le spese giudiziarie e le ripetibili (art. 148 cpv. 2 CPC);

considerato nondimeno che la tassa di giustizia va adeguatamente ridotta per tenere conto del fatto che non è stata emanata una decisione di merito (art. 21 LTG);

ritenuto che per l’art. 150 CPC le ripetibili sono fissate entro i limiti della tariffa dell’Ordine degli avvocati, tenendo conto della natura e del valore della lite e delle prestazioni indispensabili del patrocinatore, ragion per cui l’importo di fr. 600.-- a favore del Patriziato di __________ appare nella fattispecie equo e consono all’impegno profuso da quest’ultimo nella procedura di ricorso, mentre non si giustifica di assegnare ripetibili a __________ che non ha presentato osservazioni all’appello;

per questi motivi,

decreta:

  1. L’appello è stralciato dai ruoli per desistenza.

  2. Gli oneri del presente giudizio, consistenti in:

a) tassa di giustizia fr. 100.--

b) spese fr. 50.--

fr. 150.--

sono posti a carico dell’appellante, che rifonderà al Patriziato di __________ l’importo di fr. 600.-- a titolo di ripetibili di appello. Non si assegnano ripetibili a __________.
