The President of the Pretura penale held that the accused’s objection to penal order DA 726/2006 was filed out of time. The penal order had been served by registered mail on 27 February 2006 and was deemed received on 7 March 2006 at the latest, so the objection dated 2 May 2006 and mailed on 5 May 2006 was clearly late under Arts. 208 and 210 CPP. The objection was therefore declared inadmissible. In view of the particular circumstances, the court exceptionally waived fees and costs.

Art. 208 and 210 CPP; late objection against a penal order. The objection must be filed in writing with the public prosecutor within 15 days of notification. When service is by registered mail, the decisive date is the deemed date of delivery, including postal holding time, if this is more favorable to the addressee. An objection filed only after expiry of that period is inadmissible. In exceptional circumstances, the court may waive the taking of fees and costs (consid. 1-2).

sedente con la segretaria Paola Belloli per statuire in materia di procedura penale e meglio per giudicare

ACCU 1

siccome

ritenuto colpevole di contravvenzione alla LF sugli stupefacenti;

fatti avvenuti dal gennaio 2003 sino al 2 gennaio 2006 in Ticino;

reato previsto dall'art. 19a LStup;

e meglio come al decreto d’accusa n. DA 726/2006 di data 27 febbraio 2006 del AINQ 1 per cui fu proposta la condanna

  1. Alla multa di fr. 100.-- (cento).

  2. Al pagamento della tassa di giustizia di fr. 50.-- e delle spese giudiziarie di fr. 50.--.

vista l'opposizione interposta in data 2 maggio 2006 dall'accusato;

considerato che per gli art. 208 e 210 CPP l'accusato e la parte civile hanno il diritto di inoltrare al Procuratore pubblico opposizione scritta contro le proposte contenute nel decreto d'accusa entro 15 giorni dall'intimazione;

che il decreto d'accusa è stato intimato per raccomandata al prevenuto – al suo domicilio di __________, via __________ – il 27 febbraio 2006 (cfr. timbro apposto sul retro del doc. B, pag. 2);

che tale decisione è quindi giunta al destinatario, nell'ipotesi a lui più favorevole e tenuto conto del termine di giacenza presso l'ufficio postale, il 7 marzo 2006;

che l'opposizione interposta da ACCU 1, datata 2 maggio 2006 e spedita per raccomandata il 5 maggio successivo, risulta dunque tardiva;

che data la particolarità della fattispecie si giustifica di rinunciare, in via eccezionale, al prelievo di tasse e spese del presente giudizio;

per questi motivi, visti gli art. 208 e 210 CPP,

pronuncia: 1. L'opposizione è irricevibile.

Avvertenza: contro il presente giudizio può essere interposto ricorso per cassazione alla Corte di cassazione e revisione penale. Il ricorso deve essere presentato al giudice della Pretura penale, in triplice esemplare, entro venti giorni dalla notificazione della sentenza, con la precisa indicazione dei motivi e delle norme di legge che si ritengono lese.
