Following a Federal Court remand limited to costs and party compensation, the Second Civil Chamber of the Ticino Court of Appeal recalculated the cantonal costs in light of the parties' roughly equal degree of defeat. It held that no special reasons justified departing from the rule of reciprocal defeat under Art. 148 CPC. The CHF 5,000 court costs already advanced by the plaintiff were therefore split equally between the parties, with compensation of party indemnities. No costs or indemnities were awarded for the remand decision itself.

Where neither party prevails to a clearly greater extent, costs are to be apportioned according to reciprocal defeat; a departure from this rule requires special reasons. If the parties succeed and fail in approximately equal measure, the court may order equal sharing of judicial costs and set off party indemnities. For the remand decision itself, no costs or compensation need be imposed when the case is decided in written form and the circumstances do not justify a different result (consid. 1).

con cui l’attore ha chiesto la condanna della convenuta al pagamento di US $ 110'000.- (pari a fr. 168'575.-) oltre interessi al 5% dal 5 dicembre 1997, domanda avversata dalla controparte, la quale, dopo aver denunciato la lite a __________ LI 1, e a LI 2 , denuncie la prima rimasta inevasa e la seconda cui la convenuta ha in seguito rinunciato, ha postulato la reiezione della petizione;

Ed ora in materia di spese e ripetibili della procedura cantonale

ritenuto

in fatto e in diritto:

che con sentenza 31 agosto 2004 (inc. n. 10.1999.20) la scrivente Camera ha accolto la petizione per US $ 66'666.66 oltre interessi, caricando le spese giudiziarie per 2/5 all’attore e per la rimanenza alla convenuta, pure condannata a rifondere alla controparte fr. 2'500.- per ripetibili;

che la Prima Corte Civile del Tribunale federale, con decisione 25 febbraio 2005 (4C.361/2004), ha riformato il giudizio d’appello nel senso che la petizione è stata accolta per US $ 54'666.- oltre interessi, rinviando la causa a questa Camera per nuova decisione sulle spese e sulle ripetibili della sede cantonale;

che la determinazione delle spese e ripetibili avviene secondo la reciproca soccombenza delle parti, salvo che giusti motivi -che nella fattispecie non ricorrono- impongano una diversa soluzione (art. 148 CPC);

che le parti sono risultate soccombenti in misura pressoché uguale, sicché si giustifica di caricare loro le spese in ragione di metà ciascuna e di compensare le ripetibili della sede cantonale;

che per questo giudizio non si prelevano spese e non si assegnano ripetibili;

Per i quali motivi,

richiamati per le spese gli art. 148 CPC e la LTG

dichiara e pronuncia

  1. Le spese giudiziarie di complessivi fr. 5'000.- (tassa di giustizia di fr. 4'800.-, indennità per testimoni di fr. 150.- e spese di fr. 50.-), già anticipate dall'attore, sono a carico delle parti in ragione di metà ciascuna, compensate le ripetibili.

  2. Non si prelevano spese e non si assegnano ripetibili per questa decisione.
