The Pretura penale in Bellinzona dealt with an objection to a criminal decree charging ACCU 1 with a serious traffic violation under Art. 90(2) SVG for events in Lugano on 5 August 2005. After the Procuratore pubblico asked that the decree be annulled because later findings showed another person had committed the offence, the court found from the file that the accused was likewise not involved. It therefore acquitted him without holding a trial and charged the costs to the State.

Art. 9 CPP et seq.; where the file and subsequent prosecutorial findings show that the accused is not the perpetrator of the offence, the criminal decree may be annulled and an acquittal entered without debate. In such a case, the court may decide on the basis of the dossier alone when the absence of the accused's involvement is clear from the record and additional clarification is unnecessary (consid. implicit). Upon acquittal, procedural costs are borne by the State.

sedente con Laura Rossini in qualità di segretaria, per giudicare

ACCU 1

prevenuto colpevole di infrazione grave alle norme della circolazione;

fatti avvenuti il 5 agosto 2005 a Lugano;

reato previsto dall'art. 90 cifra 2 LCStr;

perseguito con decreto d’accusa n. 3459/2005 di data 19 settembre 2005 del AINQ 1 che propone la condanna dell'accusato:

  1. Alla multa di fr. 700.-- (settecento).

  2. Al pagamento della tassa di giustizia di fr. 100.-- e delle spese giudiziarie di fr. 100.--.

vista l'opposizione interposta tempestivamente in data 3 ottobre 2005 dall'accusato;

preso atto che con lettera 19 settembre 2005 il Procuratore pubblico ha chiesto di annullare il decreto di accusa, poiché da risultanze posteriori a tale atto è risultato che il reato è stato commesso da altra persona;

ritenuto che l’estraneità dell’accusato emerge anche dall’esame degli atti, così come completati in data odierna dall’accusa;

considerato che nell’evenienza descritta si può procedere al proscioglimento dell’imputato senza indire il dibattimento;

richiamati gli art. 9 e segg. CPP;

proscioglie ACCU 1

dall’imputazione di infrazione grave alle norme della circolazione per i fatti descritti nel decreto di accusa a suo carico.

carica le spese allo Stato.
