The President of the Pretura penale in Bellinzona dealt with an objection to a criminal penalty decree. After receiving notice that the objection had been withdrawn on 23 March 2004, the court struck the case from the docket and declared the penalty decree enforceable. It also decided not to levy a court fee, but ordered the objecting party to bear the costs of the decision, fixed at CHF 30.
Art. 210-211 CPP; withdrawal of an objection to a criminal penalty decree: upon valid withdrawal, the objection proceedings are to be struck from the docket and the penalty decree becomes enforceable. The court may allocate the costs of the procedural order to the objecting party and dispense with a court fee, as expressly ordered in the decision.
