The President of the Penal Court of Bellinzona dealt with an objection that had been withdrawn by letter before the ruling. The court struck the case from the docket and declared the criminal decree of accusation enforceable. It also rejected the request for exemption from costs as wholly unsubstantiated. No judicial fee was imposed, but procedural costs of CHF 30 were charged to the objecting party.
Art. 210-211 CPP; withdrawal of the objection in summary penalty proceedings: once the objection is withdrawn, the objection proceedings are to be struck off and the summary penalty order becomes enforceable. A request for exemption from costs must be substantiated; an unmotivated request does not justify waiver of procedural costs. Where no judicial fee is levied, the court may nonetheless allocate the expenses of the decision to the withdrawing objector.
