The accused, represented by counsel, withdrew the objection filed against a penal decree. The Pretura Penale therefore struck the case from the docket and declared the penal decree enforceable. The court also ordered that no fees or costs be levied in the proceedings.
Art. 210 cpv. 3 CPP; withdrawal of an objection to a penal decree: if the accused withdraws the objection, the objection proceedings are to be struck out and the penal decree becomes enforceable. In such a case, absent contrary grounds, no procedural fees or costs are charged (consid. 1-2).

interposta al decreto d’accusa n. di data 18 ottobre 2004 del AINQ 1
considerato che con suo scritto del 2/3 dicembre 2004 l’accusato, per il tramite del proprio difensore, ha dichiarato di ritirare seduta stante la suddetta opposizione;
richiamato l’art. 210 cpv. 3 CPP;
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
§ L'incarto è ritornato al AINQ 1 per quanto di sua competenza.
Non si prelevano né tasse né spese relative al presente giudizio.
