The accused objected to criminal decree DA 2687/2004, but counsel withdrew the objection by letter dated 25 October 2004. The Pretura penale therefore struck the proceedings from the docket, cancelled the scheduled public hearing, and returned the file to the issuing authority. The decree of accusation became enforceable. Court fees of CHF 50 and costs of CHF 30 were charged to the objector.

Richiamata l'opposizione 26 settembre 2004 di

ACCU 1 , difeso da: DI 1

interposta al decreto d'accusa n. DA 2687/2004 di data 16 agosto 2004 del AINQ 1

preso atto del ritiro della suddetta opposizione con lettera del 25 ottobre 2004 del difensore;

visti gli art. 210 e 211 CPP,

decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.

  1. Il pubblico dibattimento, già fissato per il 1. febbraio 2005 alle ore 09:00 non avrà quindi luogo; l'incarto è ritornato al AINQ 1 per quanto di sua competenza.

  2. La tassa di giustizia di fr. 50.00 e le spese relative alla presente decisione sono a carico dell'opponente.
