ritenuto colpevole di contravvenzione alla LF sul trasporto pubblico;
fatti avvenuti il 13.10.2003 e il 17.10.2003 a __________;
reato previsto dall'art. 51 LTP;
e meglio come al decreto d’accusa n. DA / di data __________ 2004 del ___________ per cui fu proposta la condanna
Alla multa di fr. 100.--.
Al versamento alla parte civile __________ dell'importo di fr. 160.--, a titolo di risarcimento.
Al pagamento della tassa di giustizia di fr. 50.-- e delle spese giudiziarie di fr. 50.--.
vista l'opposizione interposta tempestivamente in data 3 febbraio 2004 dall'accusato;
considerato che dai documenti ora agli atti risulta che il signor Corti ha versato alla parte civile, nel termine richiesto, l'importo di fr. 160.- di cui all'invito 10 dicembre 2003 del Procuratore pubblico;
visto quanto sopra il Ministero pubblico recede dal perseguire penalmente contro il signor __________, come avrebbe fatto se egli non avesse negligentemente omesso di comunicargli il citato pagamento;
pronuncia: 1. Il DA __________/__________è annullato e non si fa luogo a procedimento penale nei confronti di __________ __________ per i fatti del 13 ottobre e 17 ottobre 2003 a __________.
Non si prelevano né tasse né spese.

Avvertenza: contro il presente giudizio può essere interposto ricorso per cassazione alla Corte di cassazione e revisione penale.
