The Ticino criminal court noted that the objection to a decree of accusation had been withdrawn by counsel on 30 March 2004. It therefore struck the case from the docket, held that the decree of accusation had become enforceable, and cancelled the already scheduled public hearing of 13 April 2004. The objecting party was ordered to pay the justice fee of CHF 50 and the costs of the decision.
Art. 210–211 CPP; withdrawal of an objection against a decree of accusation. Where the objection is validly withdrawn, the objection proceedings are terminated, the case is struck from the docket, and the decree of accusation becomes enforceable. The scheduled hearing falls away. Costs of the withdrawal-triggered termination are charged to the objecting party, absent special circumstances.
