The objector withdrew his objection to a penalty order by letter dated 31 July 2003. The Pretura penale therefore struck the case from the docket, held that the penalty order became enforceable, cancelled the already scheduled public hearing, and returned the file to the prosecutor for further action within his competence. Court fees of CHF 100 and expenses of CHF 50 were charged to the objector.
Arts. 210-211 CPP; withdrawal of an objection against a decree d'accusa: upon valid withdrawal, the criminal proceedings are struck from the docket and the decree d'accusa acquires enforceability; any already fixed hearing is cancelled and procedural costs may be charged to the objector.
