The President of the Pretura penale in Bellinzona dealt with an objection to a summary penal decree. On 7 March 2003, the objecting party withdrew the objection. The court therefore struck the proceedings from the roll and declared the penal decree enforceable. It also ordered that no court fees or costs be charged. The matter was returned to the public prosecutor for further action within his competence.
Art. 210–211 CPP; withdrawal of objection to a summary penal decree. If the objection is withdrawn, the objection proceedings are discontinued and the penal decree becomes enforceable; the court may strike the matter from the docket. In the absence of contrary indications, no fees or costs are charged where the order so provides.
