The defendant withdrew the opposition to a criminal decree of accusation. The Pretura penale therefore struck the case from the docket, declared the decree of accusation enforceable, and cancelled the already scheduled public hearing. Costs of CHF 50 were charged to the objector.
Art. 210 cpv. 3 CPP; withdrawal of opposition against a decree of accusation. Where the accused withdraws the opposition before the hearing, the objection proceedings are terminated, the case is struck from the docket, and the decree of accusation enters into force and becomes enforceable. The scheduled main hearing falls away. The costs of the decision may be charged to the objecting party, in particular where the proceedings are ended by the withdrawal of the objection.

Richiamata l'opposizione 5 novembre 2003 di
interposta al decreto d’accusa n. DA / di data __________ 2003 del
considerato che con scritto 17 marzo 2004 il prevenuto, per il tramite del proprio patrocinatore, ha dichiarato di ritirare la suddetta opposizione;
richiamato l’art. 210 cpv. 3 CPP;
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
2.Il pubblico dibattimento, già fissato per il 26 marzo 2004 alle ore 09:30 non avrà quindi luogo.L'incarto è ritornato al __________ per quanto di sua competenza.
La tassa di giustizia in Fr. 20.00 e le spese per complessivi Fr. 30.00, relative alla presente decisione, sono a carico dell'opponente.
