The Pretura penale noted the withdrawal of an opposition to a decree of accusation and ordered the proceedings struck from the roll. As a result, the decree of accusation became enforceable and the scheduled public hearing of 19 February 2004 did not take place. The opponent was ordered to pay court fees and judicial costs totaling CHF 80.
Art. 210-211 CPP; withdrawal of opposition to a decree of accusation: upon valid withdrawal, the court strikes the proceedings from the roll and the decree of accusation becomes enforceable. The scheduled hearing is cancelled as moot. Costs of the opposition proceedings are borne by the opponent withdrawing the challenge.

Richiamata l'opposizione 16 ottobre 2003 di
interposta al decreto d’accusa n. DA / di data __________ 2003 del
preso atto del ritiro della suddetta opposizione con lettera 16 febbraio 2004,
visti gli art. 210 e 211 CPP,
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
Il pubblico dibattimento, già fissato per il 19 febbraio 2004 alle ore 09:15 non avrà quindi luogo; l'incarto è ritornato al per quanto di sua competenza.
La tassa di giustizia e le spese giudiziarie sono a carico dell'opponente.
