The Ticino Criminal Court, acting through a single judge, struck the objection proceedings from the rolls after the accused withdrew the objection to the summary penalty decree. As a result, the decree of accusation became enforceable and the scheduled public hearing did not take place. The court returned the file to the public prosecutor for further action within his competence. Court costs and the justice fee, totaling CHF 80, were imposed on the objecting party.
Art. 210 cpv. 3 CPP; withdrawal of an objection against a summary penalty decree: upon valid withdrawal, the objection proceedings are to be struck off, the penalty decree becomes enforceable, and any hearing already fixed falls away. The court may also allocate the costs of the terminated objection proceedings to the objecting party (consid. implicit).
