The opponent withdrew the objection to a decree of accusation in a criminal matter. The Pretura penale therefore struck the case from the rolls, declared the decree of accusation enforceable, cancelled the already scheduled public hearing, and sent the file back for further handling as needed. Court fees of CHF 50 and judicial expenses of CHF 30 were charged to the opponent.
Arts. 210-211 CPP; withdrawal of the objection against a decree of accusation: upon valid withdrawal, the objection proceedings are terminated, the case is struck from the docket, and the decree of accusation acquires enforceability; the scheduled public hearing becomes unnecessary.
