Art. 31 cpv. 1 and Art. 126 cpv. 1 CPS; withdrawal of the complaint: where the injured party validly withdraws the complaint, the criminal proceedings must be discontinued and struck off. On costs, Art. 9 cpv. 3 and 5 CPP permit the court to waive the imposition of taxes and costs in the circumstances determined by the decision. The proceeding becomes devoid of object once the complaint is withdrawn, so continuation is excluded.
