The President of the Pretura penale noted the withdrawal of the objection against a criminal decree of accusation and, pursuant to Arts. 210 and 211 CPP, struck the case from the docket. The decree of accusation therefore became enforceable. No justice fee was levied, but the objector was ordered to bear the costs of the decision, assessed at CHF 30. The file was returned to the assistant public prosecutor for further action within her competence.
Arts. 210 and 211 CPP; withdrawal of the objection to a decree of accusation: upon valid withdrawal, the objection proceedings are terminated, the case is struck from the docket and the decree of accusation becomes enforceable. The deciding authority may allocate the costs of the withdrawal-based termination to the objector and waive the justice fee, as appropriate under the applicable procedural rules.
