The accused withdrew his objection to the criminal decree of accusation. The President of the Pretura penale, Marco Kraushaar, noted the withdrawal, struck the proceedings from the docket, and declared the decree enforceable. The file was returned to the public prosecutor Antonio Perugini for further action within his competence. The court also ordered that no court fees or costs be charged.
Art. 210-211 CPP; withdrawal of opposition to a decree of accusation: where the accused withdraws the objection by declaration, the objection proceedings are terminated, the case is struck from the docket, and the decree of accusation acquires enforceability. In such a procedural termination, the court may order that no fees or costs be levied, depending on the express dispositive order (consid. 1-2).
