Two women had filed objections to two penalty decrees. Before the hearing, defense counsel withdrew one objection. The Pretura penale in Bellinzona struck that criminal file from the roll and declared the corresponding decree enforceable. For the other accused, the court ordered the matter to proceed separately and stated that the already-postponed public hearing would take place. Court fees of CHF 50 and judicial costs were charged to the first named woman.
Art. 210-211 CPP; effect of withdrawal of an objection to a penalty decree and procedural severance: where the objection is withdrawn, the court strikes the matter from the roll and the penalty decree acquires enforceability. If objections concern multiple accused, the court may order separate proceedings for the remaining accused. Costs of the order may be charged to the party against whom the procedural consequence is directed.
