In an objection procedure against a decree of accusation, the President of the Pretura penale noted that the complainant had withdrawn the complaint by letter of 3 June 2003. Referring to Arts. 31(1) and 144(1) CP, the court struck the proceedings from the roll and returned the file to the public prosecutor for whatever further action fell within his competence. No fees or costs were imposed.
Art. 31 cpv. 1 e art. 144 cpv. 1 CP; withdrawal of the complaint in a private-prosecution-related offence renders continuation of the criminal proceedings unnecessary, so that the court strikes the case from the roll and remits the file to the public prosecutor for further competence-related action. In such a situation, no court fees or costs are levied.
