The defendant withdrew her objection to a criminal decree of accusation by letter of 8 July 2003. The Pretura penale therefore struck the matter from the roll, held that the decree of accusation became enforceable, and returned the file to the public prosecutor for the remaining matters. The court ordered no justice fee, but imposed the costs of the decision, fixed at CHF 30, on the objecting party.

Arts. 210-211 CPP; withdrawal of an objection against a criminal decree of accusation: where the objecting party withdraws the objection, the objection proceedings become moot and are struck from the roll; the decree of accusation attains final and enforceable status. The file is returned to the prosecuting authority for any further action. Costs of the striking-off decision may be charged to the objecting party, even if no justice fee is levied (consid. 1-2).
