The President of the Criminal Court of Bellinzona noted the accused’s withdrawal of his opposition to a decree of accusation. The court therefore struck the matter from the docket and declared the decree enforceable. No court fee was levied, but the procedural costs of CHF 30 were charged to the objector.
Art. 210–211 CPP; withdrawal of opposition against a decree of accusation: once the opposition is withdrawn, the criminal proceedings are removed from the docket and the decree of accusation attains enforceability. The withdrawal is dispositive; the court does not examine the merits of the accusation. Costs of the procedural order may be charged to the withdrawing objector (consid. 1–2).
