The President of the Criminal Court of Bellinzona recorded the accused’s withdrawal of his opposition to decree of accusation DAP 3005/2002. Applying Arts. 210 and 211 CPP, the court struck the proceedings from the roll, declared the decree of accusation enforceable, cancelled the already scheduled public hearing of 3 September 2004, and sent the file back to the prosecuting authority for further action within its competence. No costs or fees were imposed.

interposta al decreto d’accusa n. DAP 3005/2002 di data 9 dicembre 2002 del AINQ 1

preso atto del ritiro della suddetta opposizione con lettera 1. settembre 2004,

visti gli art. 210 e 211 CPP,

decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.

  1. Il pubblico dibattimento, già fissato per il 3 settembre 2004 alle ore 09:00 non avrà quindi luogo; l'incarto è ritornato al AINQ 1 per quanto di sua competenza.

  2. Non si prelevano né tasse, né spese.
