The President of the Pretura penale noted that the opponent had withdrawn his opposition to a decree of accusation by letter of 3 June 2003. Applying Arts. 210 and 211 CPP, the court struck the matter from the docket and declared the decree of accusation enforceable. No court fee was levied, but judicial costs of CHF 30 were imposed on the opponent.
Art. 210-211 CPP; withdrawal of opposition to a decree of accusation: once the opposition is withdrawn, the objection proceedings are terminated, the case is removed from the docket, and the decree of accusation attains enforceability. The court need not examine the merits of the decree; it merely records the withdrawal and decides on costs. In the absence of a court fee, the judicial costs may be charged to the objecting party (consid. implicit).
