The opponent withdrew the objection to a criminal accusation decree before the Pretura penale of Bellinzona. The president, Marco Kraushaar, therefore struck the case from the docket and held that the accusation decree became enforceable. No justice fee was levied, but the procedural costs of CHF 30 were charged to the opponent.
Art. 210 f. CPP; withdrawal of the objection against a decree of accusation: upon valid withdrawal, the criminal proceedings are struck out and the decree of accusation becomes enforceable. The court may waive the justice fee while charging the costs of the decision to the objecting party, absent contrary grounds (consid. implicit).
