The opponent withdrew on 25 August 2003 the objection filed against a penal decree issued by the public prosecutor Antonio Perugini. The President of the Pretura penale, Marco Kraushaar, therefore struck the proceedings from the docket, cancelled the scheduled public hearing of 2 September 2003, and returned the file to the prosecutor. The penal decree became enforceable. Court fees and related costs were imposed on the opponent.
Arts. 210-211 CPP; withdrawal of objection against a decree d’accusa: if the objection is withdrawn, the objection proceedings are discontinued, the file is returned to the public prosecutor, and the penal decree becomes enforceable. The objecting party bears the court fee and the costs of the discontinuance order.

Yes. The proceedings are struck from the docket and the penal decree becomes enforceable.
Once the objection was withdrawn, there was no longer a live challenge to the decree; under Arts. 210 and 211 CPP the court discontinued the proceedings and returned the file to the prosecutor.
