The Ticino Criminal Court judge dealt with an objection that had been withdrawn by letter of 27 January 2004. On 29 January 2004, the court struck the case from the roll, cancelled the hearing scheduled for 5 February 2004, and held that the criminal decree of accusation became enforceable. The opponent was ordered to pay CHF 50 in court fee and CHF 30 in costs, for a total of CHF 80. The file was returned to the competent authority for further handling.
Art. 210-211 CPP; withdrawal of objection against a criminal decree of accusation: the withdrawal renders the challenge devoid of object, so the proceeding is struck from the roll and the decree becomes enforceable. In such a case, the court may cancel any scheduled hearing and allocate the procedural costs to the withdrawing objector (consid. implicit in dispositive).

Richiamata l'opposizione 6 maggio 2003 di
interposta al decreto d’accusa n. DA / di data __________ 2003 del
preso atto del ritiro della suddetta opposizione con lettera 27 gennaio 2004,
visti gli art. 210 e 211 CPP,
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
Il pubblico dibattimento, già fissato per il 5 febbraio 2004 alle ore 10:15 non avrà quindi luogo; l'incarto è ritornato al per quanto di sua competenza.
La tassa di giustizia di fr. 50.00 e le spese di fr. 30.00 relative alla presente decisione sono a carico dell'opponente.
