The Pretura penale struck the criminal proceedings off the docket after all private complainants withdrew their complaints before judgment. The court held that insult is a complaint-based offence and that a complaint may be withdrawn until the first-instance judgment. As the withdrawal removed an indispensable procedural prerequisite, the case became moot and had to be removed from the files. The court ordered no taxes or costs and returned the files to the public prosecutor for any further action within his competence.

Art. 31 cpv. 1 CPS; art. 177 cpv. 1 CPS: withdrawal of complaint and procedural consequence in complaint-based offences. A complainant may validly withdraw the complaint until the first-instance judgment. Where the offence prosecuted is subject to complaint, the complete withdrawal of all complaints extinguishes the indispensable procedural prerequisite and renders the criminal proceedings devoid of object; the court must accordingly strike the case off the roll (consid. 1). In such a situation, absent any remaining subject matter, no court costs are levied (consid. 2).

preso atto che, nel corso del dibattimento del 20 novembre 2003, la signora __________ __________ ha ritirato ad ogni effetto di legge per sé e a nome e per conto delle sue figlie __________ __________ le querele sporte a suo tempo, quale loro rappresentante legale, nei confronti dei signori __________, __________, e __________ __________, __________ __________; e

che, in data 25 novembre 2003, la signora __________ __________, __________ __________, dichiarava di accettare solo delle scuse fatte pubblicamente, cioè di persona o tramite lettera, ma che ciò non era ancora successo; e che la stessa, con scritto 27 febbraio 2004, comunicava che le cose si erano messe a poste, che la signora __________ le avevo chiesto scusa e che la sua lettera del 25 novembre 2003 non aveva più valore; in altre parole, essa ha manifestato la volontà di desistere dalla querela sporta nei confronti della signora __________ da sua madre __________, la quale agiva al tempo quale sua rappresentante legale;

considerato che ogni querelante può desistere dalla querela finché non sia stata pronunciata la sentenza del giudice di prima istanza (art. 31 cpv. 1 CPS), e che il reato di ingiuria è un reato a querela di parte (art. 177 cpv. 1 CPS);

ritenuto che, nel caso in esame, tutte le parti civili hanno dichiarato esplicitamente di desistere dalla loro querela;

che, di conseguenza, il procedimento penale in parola diviene privo di oggetto in difetto di un imprescindibile presupposto processuale (cfr. Jörg Rehberg, Andreas Donatsch, Strafrecht I, 7. ed., Zurigo 2001, p. 328);

visti gli art. 31 cpv. 1 e art. 177 CPS;

decreta: 1. I procedimenti di cui agli inc. no. __________e __________sono stralciati dai ruoli.

Gli incarti sono ritornati al Procuratore pubblico Nicola Respini, __________, per quanto di sua competenza.
