The President of the criminal court noted the withdrawal of the objection to a penal decree and ordered the case struck from the docket. As a result, the penal decree became enforceable. No court fee was levied, but the procedural costs of CHF 30 were charged to the objector. The matter was sent back to the substitute public prosecutor for further handling within her competence.
Art. 210-211 CPP; withdrawal of objection against a penal decree: upon valid withdrawal, the objection proceedings become devoid of object and are struck off, with the penal decree acquiring executory force. The authority may allocate procedural costs to the objector and dispense with a court fee; the withdrawal ends the adversarial stage without review of the merits.
