The objector withdrew the objection to a penal decree before the scheduled hearing. The Pretura penale therefore struck the case from the docket, held that the penal decree became enforceable, and cancelled the public hearing. The file was returned to the substitute public prosecutor for any further action within competence. Court costs, consisting of a judicial fee of CHF 70 and judicial expenses of CHF 50, were charged to the objector.
Art. 210-211 CPP; withdrawal of an objection to a penal decree; procedural consequence. Where the objection against a penal decree is withdrawn, the objection proceedings become devoid of object and are struck off the docket; the penal decree attains enforceability. Any scheduled public hearing is cancelled, and the costs of the decision are borne by the objecting party.
