The Pretura penale noted that the accused had filed an opposition to a penal decree but later withdrew it through counsel’s letter. Applying Arts. 210 and 211 CPP, the court struck the case from the docket and declared the penal decree enforceable. It also ordered that no court fee be collected, while the decision-related expenses of CHF 30 were borne by the objector. The matter was then returned to the public prosecutor for further action within his competence.
Art. 210-211 CPP; withdrawal of opposition to a penal decree: once the opposition is validly withdrawn, the objection proceedings are terminated, the case is struck off the docket and the penal decree becomes enforceable. The court may at the same time allocate the costs of the termination order to the objector; waiver of a court fee does not preclude charging procedural expenses (consid. implicit).
