The accused withdrew the opposition to a summary criminal penalty order during the hearing before the Pretura penale in Bellinzona. The single judge, Marco Ambrosini, therefore struck the matter from the docket and declared the penalty order enforceable under Arts. 210 and 211 CPP. The court also ordered that no court fees or costs be levied for the decision.
Art. 210-211 CPP; withdrawal of opposition to a summary penalty order; if the opposition is withdrawn during the hearing, the objection proceedings are terminated, the case is struck from the docket and the penalty order becomes enforceable. The court may, in the same order, dispense with fees and costs where so provided or decided. The withdrawal produces immediate procedural extinction of the objection without a merits review of the penalty order.
