The accused withdrew, at the hearing, the opposition previously filed against the public prosecutor’s decree of accusation. The Pretura penale therefore struck the case from the docket and declared the decree enforceable. It also ordered that no court fees or costs be charged. The order was issued by single judge Marco Ambrosini in Bellinzona and the file was returned to the public prosecutor for further action within his competence.
Art. 210-211 CPP; withdrawal of opposition to a decree of accusation: where the opposition is validly withdrawn during the hearing, the objection proceedings become moot and must be struck off; the decree of accusation acquires enforceability. In the absence of specific contrary grounds, the court may order that no fees or costs be levied.
