The Bellinzona Criminal Court of Peace struck the objection proceedings from the docket after the accused withdrew the opposition to the penal order. The court held that, in light of the withdrawal, the summary penalty order became enforceable and the scheduled public hearing of 19 May 2004 would not take place. No taxes or costs were charged for the decision.
Art. 210-211 CPP; withdrawal of opposition to a summary penalty order: once the objection is withdrawn, the objection proceedings are terminated, the penal order becomes enforceable, and any already scheduled public hearing is cancelled. In such a situation, the court issues a procedural strike-out without allocating court costs, unless the statute provides otherwise.
