Résumé

The Pretura penale in Bellinzona, through single judge Marco Ambrosini, dealt with an objection to a criminal decree of accusation after the opponent withdrew the objection by letter of 15 October 2003. The court, relying on Arts. 210 and 211 CPP, struck the matter from the docket and declared the decree enforceable. It also ordered the opponent to pay the costs of the decision, fixed at CHF 80 in total.

Where the objection to a decree of accusation is withdrawn, the objection proceedings are discontinued, the case is struck from the roll, and the decree of accusation becomes enforceable. The withdrawing party bears the procedural costs of the discontinuance, absent grounds to decide otherwise.
