The Pretura penale noted the withdrawal of the defendant’s opposition to a penalty order. As no opposition remained, the judge struck the case from the docket, declared the penalty order enforceable, and returned the file to the public prosecutor for further action within his competence. The court also ordered that no fees or costs be levied.
Art. 210-211 CPP; withdrawal of opposition to a penalty order: if the opposition is withdrawn, the criminal proceeding concerning the objection is terminated by striking the case from the docket, and the penalty order becomes enforceable. The file is returned to the public prosecutor for the steps falling within his competence. In the absence of any further contentious issue, no fees or costs need be charged (consid. 1-2).
