Résumé

The Pretura penale of Bellinzona struck off objection proceedings to a decree of accusation after the complainant and civil party withdrew the complaint by letter of 25 February 2003. The scheduled public hearing of 11 March 2003 was cancelled and the file returned to the public prosecutor for anything further within her competence. The court ordered that no fees or costs be collected.

Art. 31 cpv. 1 and 217 cpv. 1 CPS; withdrawal of the complaint during pending objection proceedings renders the continuation of the public hearing moot and justifies striking the case from the rolls. The criminal file is to be returned to the prosecuting authority for any further measures within its competence. Where the proceedings are terminated on this basis, no court fees or costs are charged.
