The accused filed an objection against a penalty order issued by the public prosecutor. At the hearing before the Pretura penale, the complainant withdrew the complaint. Judge Marco Ambrosini therefore ordered the proceedings struck from the rolls and returned the file to Public Prosecutor Emanuele Stauffer for any further action within his competence. No fees or costs were levied.
Art. 31 cpv. 1 CP; Art. 173 CP: upon withdrawal of the complaint during the hearing, the criminal proceedings lack a continuing basis and are to be struck off; the court may return the file to the public prosecutor for the consequences falling within his competence. Where the case is discontinued on this ground, no court fees or costs are levied.
