Résumé

The accused objected to a criminal decree issued by the public prosecutor. During the proceedings, the complaints were withdrawn by two letters and one declaration. The Pretura penale of Bellinzona, by single judge Marco Ambrosini, therefore struck the case from the rolls and returned the file to the public prosecutor for matters within his competence. No court fees or expenses were charged.

Withdrawal of complaints; discontinuance of objection proceedings. Where the private complaints underlying a penal decree are validly withdrawn during the objection procedure, the criminal court must strike the case from the roll and return the file to the public prosecutor for any residual competence. In such circumstances, no fees or costs are levied (consid. implied by dispositive).
