The Pretura penale noted the withdrawal of the opposition to a criminal accusation decree by letter from the defense. It therefore struck the case from the docket, cancelled the hearing already set for 4 December 2003, and held that the accusation decree became enforceable. The opponent was ordered to pay a court fee of CHF 50 and expenses of CHF 30. The decision was issued by single judge Marco Ambrosini.
Arts. 210-211 CPP; withdrawal of opposition against a criminal accusation decree: upon valid withdrawal, the objection proceedings are struck from the docket, the decree of accusation enters into force and the scheduled hearing becomes moot; procedural costs may be charged to the withdrawing opponent in accordance with the court's cost order.
