In a direct appeal for USD 1,046,825.14 plus interest, the parties reached a settlement before the Ticino Court of Appeal ruled. On the plaintiff's request, the Second Civil Chamber struck the case from the docket under Art. 351 CPC. Consistent with the settlement, the court left the CHF 550 in judicial fees and expenses to the plaintiff and ordered the parties' legal costs to be compensated.
Art. 351 CPC; settlement pending appeal and allocation of costs: where the parties reach a transaction that puts an end to the dispute, the appellate court strikes the proceedings from the roll. If the settlement also governs costs, the court gives effect to that agreement; otherwise, judicial costs and party compensation are determined according to the applicable cantonal tariff rules (here TG).

con la quale l'attrice ha chiesto la condanna della convenuta al pagamento dell'importo di USD 1'046'825,14 oltre interessi al 5% dal 6 ottobre 2001.
Ed ora sulla richiesta 25 febbraio 2002 del patrocinatore dell'attrice il quale chiede lo stralcio della causa, le parti essendo addivenute ad un accordo di transazione che mette fine al litigio e che regola anche la ripartizione di spese e ripetibili nel senso che l'attrice si assume le tasse e spese giudiziarie mentre le indennità ripetibili sono compensate.
Visto l'art. 351 CPC e, per le spese, la vigente TG
pronuncia
La causa inc. no. __________, promossa direttamente in appello con petizione 29 novembre 2001 da __________ contro __________, è stralciata dai ruoli.
La tassa di giustizia di Fr. 500.- e le spese di Fr. 50.- (totale Fr. 550.-), già anticipate dall'attrice, rimangono a suo carico, compensate le ripetibili.
