The applicants requested recognition and declaration of enforceability in Switzerland of a Romanian adoption judgment. Before the Court of Appeal could rule on the merits, they withdrew the request. The First Civil Chamber therefore struck the matter from the docket for withdrawal and, considering the particular circumstances, waived the collection of court fees and expenses. The tutelary delegation was notified of the decision.
Art. 352 cpv. 2 CPC; withdrawal of the application in appellate proceedings for delibation of a foreign judgment. If the applicant withdraws the request before a merits decision, the court strikes the case from the docket. In particular circumstances, it may dispense with the collection of judicial fees and costs.

ritenuto che nelle particolari circostanze del caso appare giustificato rinunciare al prelievo di oneri processuali;
