The Rekurskommission held that in definitive debt enforcement the creditor bears a strict burden of substantiation. Not only must the enforcement title itself be clear and unequivocal, but all circumstances affecting the outstanding balance, such as instalments or interest, must also be comprehensibly set out. In an accounting relationship, the creditor must clearly explain the calculation, identify the decisive amounts, and present the necessary facts in a way that allows the judge to decide without searching through the file or having to infer the basis of the request.

Art. 80 f. SchKG; § 97 aZPO (TG): In the procedure for definitive enforcement, the debtor’s objections are narrowly limited, which presupposes an absolutely clear and unequivocal enforcement title. The creditor must therefore substantiate the request with sufficient clarity also as to all circumstances determining the outstanding balance, in particular instalments and interest. Substantiierungspflicht des Gläubigers im Rechtsöffnungsverfahren

Die Einredemöglichkeiten des Schuldners sind im Verfahren betreffend definitive Rechtsöffnung äusserst beschränkt (vgl. Art. 81 Abs. 1 SchKG). Korrelat hiezu ist, dass der Rechtsöffnungstitel absolut klar und eindeutig sein muss. Nur demjenigen Gläubiger, welcher zweifelsfrei einen Anspruch gegenüber dem Schuldner geltend machen kann, steht die Möglichkeit offen, auf raschem sowie einfachem Weg und insbesondere ohne erneute Infragestellung der Forderung zu seinem Geld zu gelangen. Bei Entscheiden, in welchen rechtskräftig über die Zahlungspflicht eines Schuldners befunden wurde, ist dies in aller Regel der Fall. Gewähr dafür, dass der Schuldner dem Gläubiger die in Betreibung gesetzte Forderung tatsächlich schuldet, bieten insbesondere die Mitwirkungsrechte und Rechtsmittelmöglichkeiten des Betriebenen im ursprünglichen Gerichts- bzw. Steuerveranlagungsverfahren (Fritzsche/Walder, Schuldbetreibung und Konkurs nach schweizerischem Recht, Bd. I, 3.A., § 19 N 2 ff., 9 ff.; Amonn/Gasser, Grundriss des Schuldbetreibungs- und Konkursrechts, 6.A., § 19 N 32 ff., 44, 50 ff.). Nicht nur der Rechtsöffnungstitel an sich darf jedoch keine Zweifel an der Schuld entstehen lassen; auch die übrigen Gegebenheiten, welche die Höhe des Ausstands letztlich noch beeinflussen (z.B. Ratenzahlungen, Zinsforderungen), müssen durchschau- und nachvollziehbar sein. Dies gilt insbesondere bei einem Abrechnungsverhältnis. Dabei ist es Sache des Gläubigers, seine Forderung klar zu begründen, die Zahlen, welche für den Entscheid massgebend sind, deutlich zu nennen und dem Rechtsöffnungsrichter auch alle übrigen Fakten, die für die Entscheidfindung notwendig sind, verständlich vorzutragen. Er muss seiner Substantiierungspflicht, welche sich ihrerseits aus der Dispositionsmaxime ergibt (§ 97 ZPO), rechtsgenüglich nachkommen. Der Richter ist nicht gehalten, sich die Angaben in mühsamer Kleinarbeit aus diversen Akten zusammenzusuchen, weitere Unterlagen beizuziehen oder zu rätseln, aufgrund welcher Vorkommnisse wohl der Gläubiger im nachgesuchten Umfang Rechtsöffnung verlangt (RBOG 1982 Nr. 13, 1959 Nr. 20).
