The Obergericht clarified, under Art. 153 aZPO (TG), that party statements on maintenance made during instruction proceedings are generally not binding if no divorce settlement was concluded there. However, this non-binding effect presupposes that the parties submit concrete requests no later than at the main hearing. If no such requests are made and the earlier statements are not withdrawn, the court must rely on the instruction-stage declarations because no other request exists.

§ 153 aZPO (TG)


Nach der Rechtsprechung des Obergerichts besteht grundsätzlich keine Bindung an Äusserungen einer Partei über die Höhe von Unterhaltsbeiträgen im Instruktionsverfahren, sofern innerhalb desselben nicht eine Scheidungskonvention abgeschlossen wird (RBOG 1994 Nr. 3). Dass Erklärungen der Parteien während der Instruktionseinvernahmen ohne Wirkung bleiben, bedingt freilich, dass spätestens in der Hauptverhandlung konkrete Anträge gestellt werden. Werden jedoch in der Hauptverhandlung keine konkreten Anträge gestellt und frühere anlässlich der Instruktionseinvernahme geäusserte Parteierklärungen nicht widerrufen, bleibt nichts anderes übrig, als mangels eines anderen Antrags auf die Erklärungen in der Instruktionseinvernahme abzustellen.
