§ 151 Abs. 2 aStPO (TG) i.V.m. § 137 Abs. 2 aStPO (TG)


1. X erhob gegen ein Strafurteil Berufung. Er verstarb vor Erledigung des Rechtsmittels.

2. Der Tod des Angeklagten lässt den staatlichen Strafanspruch erlöschen. Stirbt der Täter, so ist das Strafverfahren einzustellen (§ 152 Abs. 2 i.V.m. § 137 Abs. 2 StPO); RBOG 1979 Nr. 32, der für diesen Fall eine Abschreibung am Protokoll vorsieht, ist insofern ungenau. Der Einstellungsbeschluss ist, nachdem das erstinstanzliche Urteil nicht rechtskräftig und die Strafsache bei der Rekurskommission anhängig ist, von der Berufungsinstanz zu fällen. Die Einstellung betrifft das gesamte Strafverfahren: Ein erstinstanzliches Urteil wird, wenn dagegen die Berufung erklärt wird, als ganzes nicht rechtskräftig, denn die Berufung hemmt die Rechtskraft und Vollstreckbarkeit des angefochtenen Entscheids (§ 201 Abs. 1 StPO; Litschgi, Die Rechtsmittel im thurgauischen Strafprozess, Diss. Zürich 1975, S. 107 f.); eine Teilrechtskraft des erstinstanzlichen Strafurteils kann nur dann eintreten, wenn der Geschädigte lediglich bezüglich des Zivilpunkts Berufung erklärt hat (RBOG 1991 Nr. 33), sofern es sich dabei nicht um ein Opfer im Sinne des Opferhilfegesetzes handelt (Urteil des Obergerichts vom 2. Dezember 1993).
